Corona Constitutional #21: Ultra Vires

Der große Crash ist ausgeblieben, die Eurozone, die EZB und die Finanzmärkte scheinen  unbeeindruckt vom jüngsten Grundsatzurteil des Bundesverfassungsgerichts in Sachen Anleihenkaufprogramm. Um so größer ist das Entsetzen bei denen, die sich um die Europäische Union als Rechtsgemeinschaft sorgen. Karlsruhe hat dem Europäischen Gerichtshof in Luxemburg zum ersten Mal offen den Gehorsam aufgekündigt, hat dem EuGH bescheinigt, den Kompetenzrahmen der EU gesprengt und ein offensichtlich falsches, nicht nachvollziehbares Urteil gefällt zu haben, und das in Zeiten, wo die Herrschaft des Rechts in der EU ohnehin schon aufs äußerste prekär geworden ist. Was hat das deutsche Bundesverfassungsgericht, das bislang angesehenste und einflussreichste Verfassungsgericht Europas, wenn nicht gar der Welt, da angerichtet? Darüber spricht Max Steinbeis mit unserem Associate Editor, dem Europarechtler ALEXANDER THIELE von der Universität Göttingen.

    This demonstrates that the principle of proportionality makes it possible to do whatever is supposed to be necessary to judges, including the worst… they are making politics but they do not really know the politics they are making…

    Proportionality is a jurisdictional chewing gum principle.
    Usually used to limit individual rights for the sake of legitimate public objectives (e.g. in voting rules, individual choice vs. party representation), here it is used to limit the monetary policy instruments.
    However, not monetary policy as such is the ultimate target (the borderline between monetary and let’s say fiscal measures is fluid), but the (much ignored) UE democratic foundation, which is an inter-state sovereignty. The BVerfG is the only authority in Europe who fully understands and respects the principles of constitutional democracy: the sovereign people vote, elect representatives who support a government which acts under the scrutiny of the judicial. In particular the people’s representatives approve the taxes needed to finance their security and welfare. There is no European nor Euro-zone “people” who disposes of the instruments of democracy to approve UE or Euro-taxes.The tax payers necessarily rely on their national parliament and trust their government not to pay for expenses they do not control. A too aggressive BCE policy (e.g. unlimited acquisition of state debt of one single country) replaces national fiscal policy and tends to finance (at the cost and risk of the citizen tax payers of the other countries) willfully divergent national economies, possibly governed by anti-European majorities (Italy 2011, 2018, and maybe 2022). Fiscal coordination and discipline should not be abandoned to the BCE acting behind the curtains on the secondary public debt markets, but should be addressed publicly by the Euro-group (inter-state, not federal) authorities and ultimately by the national authorities (government, parliament, public opinion and judiciary). Could that not be the positive message of the sentence?

    Die Ankäufe von Staatsanleihen dienen laut EZB dazu, dass die Inflationsraten mittelfristig von unter, aber nahe bei 2 % liegen. Der EuGH vertritt dazu eine Nutella-Rechtsprechung („Wenn die EZB auf ihre Beschlüsse Geldpolitik draufschreibt, dann ist auch Geldpolitik drin.“). Und in diesem Podcast werden die „Kausalitäten“ der Geldpolitik in Hinblick auf bestimmte wirtschaftspolitische Folgen problematisiert.
    Wenn die EZB nicht italienische Staatsanleihen ankaufen würde, würde das vergleichsweise miese Rating Italiens (BBB) weiter herabgestuft werden und der Zinsspread zu Bundesanleihen würden sich weiter erhöhen. Die Begrenzung des Zinsspread tritt unabhängig davon ein, ob die italienischen Staatsanleihen von der EZB am Primärmarkt oder am Sekundärmarkt gekauft werden. Die Auswirkungen der EZB-Politik auf die Finanzierbarkeit des italienischen Staatshaushalts (Vermeidung höherer Zinslasten) und damit für die Existenz der Eurozone sind für mich evident.
    Mit Verlaub: Ausführungen der EZB und des EuGH, die die Auswirkungen der Geldpolitik auf den italienischen Staatshaushalt nicht in den Mittelpunkt stellen, sind für mich unseriös. Das ist ungefähr so, als ob ein leibhaftiger Elephant bei der Geburtstagsfeier im Zimmer wäre, die Geburtstagsgäste sich aber nur über irgendeine Nippesfigur im Raum unterhalten.
