  <abstract displayLabel="Summary">On 13 March 2026, the European Committee of Social Rights published the decision concerning the right to strike in essential public services (EPS) in Italy. On the one hand, the decision found that the notion of EPS is too broad and underspecified. On the other hand, it found no violation of the European Social Charter relating to the (absence of) effective judicial review. The decision overlooks the constitutional and institutional peculiarities of the Italian system and shows a limited understanding of procedural realities, which effectively neutralise the judicial oversight.</abstract>
