Auf dem zweiten Auge blind
Der Reformbedarf der juristischen Ausbildung bleibt Streitthema geblieben und wird auch Gegenstand des Deutschen Juristentags vom 16. bis 18. September in Erfurt sein. Wir möchten deshalb einen Überblick über den bisherigen Forschungsstand zur Qualität und Aussagekraft der juristischen Prüfungspraxis geben. Dabei wird deutlich, dass selbst die Verwaltung derzeit nicht davon ausgeht, in der Forschung etablierte Standards bei den Staatsprüfungen einzuhalten. Wir schlagen daher eine schnell umzusetzende Maßnahme vor, die die Klausurbewertung kurzfristig verbessern dürfte und mittelfristig zusätzliche Erkenntnisse über die Qualität der Bewertung im Staatsexamen unter Realbedingungen ermöglicht: die verdeckte Zweitkorrektur. Judiciaries Must Build Support in Societies
The continuous attack on the judiciary in Poland, starting with the subjugation of the Constitutional Court, have shown that legal safeguards provide only an illusionary protection in case both the national legislator and the Constitutional Court have been taken over by politicians who do not believe in the rule of law. Why is it relatively easy for governments to push judiciaries over? They have a fundamental weakness: their lack of connection with society. Iudex calculat: Why Constitutional Scholars Should Surmount their Allergy to Numbers
Law students often mention poor math scores as a reason to elect their course of study. Refugees of a world increasingly dominated by numbers and number-crunchers, jurists often wear the adage “iudex non calculat” as a badge of honour. Surmounting the discipline’s allergy to numbers could do some good not just to constitutional judges but also to the scholarship that concerns itself with the discussion of the constitutional texts they are supposed to apply but also with the decisions they churn out.
