Wenn Rechtsextremismus und Menschenfeindlichkeit in unserer Gesellschaft zunehmen, vollzieht sich das oft auch am Arbeitsplatz. Gerade Beamt*innen und Angestellte im öffentlichen Dienst müssen befürchten, dass Antidemokrat*innen und Extremist*innen in ihren Behörden die ihnen zur Verfügung stehenden Befugnisse für rechtsstaatswidrige und menschenfeindliche Ziele nutzen. Obstinate Choices

Denmark is currently going through a full-blown intelligence scandal. It includes charges of illegal activity lodged by the Danish Intelligence Oversight Board (TET) against the Danish foreign intelligence service (FE), as well as a range of criminal cases brought against the former head of FE, a former minister of defence, and a former intelligence officer on charges of leaking classified information. In this post, I argue that these scandals can best be understood through the lens of a series of obstinate choices made by the Danish government and its representatives. Seemingly, because key decision-makers lacked trust and got fed up with leaks, the situation was handled aggressively from the start, as a matter of principle. I explain the complex scandal but focus on specifics only in the case against former minister of defence, Claus Hjort Frederiksen, as his case is the most clear-cut and observable for outsiders. New Wine in Old Bottles

On February 14, the Grand Chamber of the European Court of Human Rights released its judgment on the Raphael Halet case. In a context of both increasing attacks against financial transparency, and failure of states to properly implement the EU directive on the protection of whistleblowers, the judgment by the Grand Chamber was a much awaited one. This case gave the Strasbourg Court an opportunity to reaffirm the importance of whistleblower protection as a human right, and amend the threshold for protection. The Penultimate Chapter in the Case of Julian Assange

After almost four years under unchanged detention conditions in the high-security prison Belmarsh, Julian Assange is facing yet another challenge. The upcoming decision of the High Court of England and Wales might ultimately determine whether Julian Assange can be extradited to the United States where he would face up to 175 years in prison if convicted on all 18 charges. If the High Court concludes that the first-instance proceedings should not be reopened, legal recourse in the United Kingdom would be exhausted. Das vorletzte Kapitel im Fall Assange

Nach bald vier Jahren unter unveränderten Haftbedingungen im Hochsicherheitsgefängnis Belmarsh sieht sich Julian Assange einer weiteren Herausforderung gegenüber. Mit der anstehenden Entscheidung des High Court of England and Wales wird von Seiten der britischen Justiz möglicherweise abschließend darüber entschieden, ob Julian Assange an die USA ausgeliefert werden kann. Wer Whistleblower nicht schützt, muss haften

Whistleblower in Deutschland haben es schwer. Bis zum 17. Dezember 2021 hätte der Bundesgesetzgeber Zeit gehabt, die „Whistleblower-Richtlinie“ in nationales Recht umzusetzen. Da er diese Frist untätig hat verstreichen lassen, entfaltet die EU-Richtlinie ihre Wirkung nun unmittelbar. Sie schützt Personen, die Verstöße gegen das Unionsrecht melden und kann zu weitreichenden Haftungsansprüchen gegenüber der Bundesrepublik führen. Continue reading >>

Modernising the United Kingdom’s Official Secrecy Laws

In the United Kingdom, proposals to reform official secrecy laws could have damaging implications for journalistic expression, whistleblowing and government transparency. As is, the Home Office proposals could lead to a situation whereby a law which prohibits whistleblowers from going outside of their organisation, and is thus incompatible with Article10 ECHR, could be replaced with an even worse law, which inhibits expression, and prevents journalists from lawfully reporting on important matters of public interest.
