Introduction: Constitutional Resilience and the German Grundgesetz

What lessons does the plight of the Polish and the Hungarian democracy hold for a seemingly stable constitutional state like Germany? How resilient would the German constitutional setup turn out to be in the case of an authoritarian majority taking and successfully holding on to power? What kind of legal or institutional changes may be helpful to make that event less likely and/or less hard to prevent? Wenn die Justiz auch einfach mal keine Ahnung hat

Stellen Sie sich vor, Sie gehen vor Gericht, und die Richterin sagt: Ja, ehrlich gesagt… weiß auch nicht. Bin ich überfragt. Tut mir leid, aber ich habe leider überhaupt keine Ahnung. Das wäre ein Fall, für den die Rechtsschutzgarantie in Artikel 19 IV Grundgesetz wie gemacht zu sein scheint, oder nicht? Ein Gericht darf sich nicht achselzuckend abwenden, wenn jemand kommt und seine Rechte einklagt. Ein Gericht hat Ahnung zu haben.
