The Abrogation of Asylum
Migration and border control are amongst the most pressing topics throughout the regions in this global super-election year. How to tackle this issue seems to be the million-dollar question and the urgency of this topic seemingly has pushed President Joe Biden – who previously pledged to reverse restrictive migration policies – to drastic measures. After failed attempts to pass a bipartisan immigration deal earlier this year, Biden is now in a race with Republican candidate Donald Trump to show a “tough stand” on the matter while ignoring core refugee law principles and arguably with little lasting effects on numbers of arrivals at the southern border.

Unconstitutionality à l’Anglaise
After long and tortuous proceedings in Parliament, the Safety of Rwanda (Asylum and Immigration) Act 2024 finally received Royal Assent on Thursday 25 April. There are so many problems with the Act and they are so fundamental that there has been speculation that the courts might refuse to apply some of the Act’s provisions. In this blogpost, I suggest that aside from the ‘hard-line’ approach of striking down or disapplying the statute in whole or in part, the courts also have a ‘soft-line’ option of declaring its unconstitutionality without denying its status as binding law. I explain how such an intervention might fit into the constitutional tradition of the UK and what may make it attractive in the case at hand.

Responsives Aufenthaltsrecht
In der politischen Debatte um Migration in Deutschland und Europa zirkulieren derzeit kontroverse, wahlweise repressive oder progressive Lösungsvorschlage. Vor dem Hintergrund dieser Debatte unterbreite ich in diesem Beitrag den rechtspolitischen Vorschlag, dem „Vollzugsdefizit“ im asylrechtlichen Bereich mittels individueller Integrationsvereinbarungen in Gestalt öffentlich-rechtlicher Verträge entgegenzuwirken und damit das Aufenthaltsrecht am Beispiel anderer Rechtsgebiete mit Vollzugsschwierigkeiten zu schulen. Individuelle Integrationsvereinbarungen zwischen Behörden und Asylbewerbern eröffnen einerseits einen transparenten Weg zur Regularisierung des Aufenthaltsstatus bei nachgewiesenen Integrationsleistungen. Andererseits erleichtern individuelle Integrationsvereinbarungen Rückführungen, da sie aufenthalts- und asylrechtliche Mitwirkungspflichten (etwa bei Passbeschaffung und Identitätsklärung) auf kooperativem Wege durchsetzen.

Zwischen Schutz, Stigma und Stereotyp
Mit der Einführung des ProstSchG im Jahr 2017 hat der Gesetzgeber in Deutschland neue gesetzliche Verpflichtungen verabschiedet, die die Situation der Prostituierten verbessern und sie vor Ausbeutung und Gewalt schützen sollen. Eine zentrale Bestimmung zur Umsetzung des intendierten Schutzes ist die Anmeldepflicht nach § 3 Abs. 1 ProstSchG, die in mehrfacher Hinsicht eine Belastung für die Anmeldepflichtigen bedeuten kann. Aus einer intersektionalen Perspektive zeigt sich, dass dieser Verpflichtung das im Diskurs verankerte klassistische und rassistische Narrativ der nicht selbstbestimmten migrantischen Sexarbeiterin nicht nur vorausgeht, sondern zugrunde liegt.
