Germany Blocks Europe-Wide Protection of Women Against Violence

Gender-based violence has dramatically increased in the European Union (EU) in recent years. In particular women are widely affected by rape. On 8 March 2022, the Commission presented a Draft Directive for comprehensive, effective and enforceable protection against gender-based violence in all EU Member States. The main point of contention in the negotiations, which could ultimately prevent the adoption of the Draft Directive, is the introduction of the common definition of the criminal offence of rape. The Directive aims to harmonize across Europe the definition of rape as a violation of the consent-based sexual act. Yet, twelve Member States, with Germany and France at the forefront, are not convinced that the EU has a sufficient legal base to regulate that issue. This article highlights the arguments for a common regulation of the criminal offence of rape in the EU under Art. 83 (1) TFEU against the doubts raised by the German Federal Ministry of Justice. Women, Rape Law and the Illusory Sex Equality Clause in the Bangladeshi Constitution

Earlier in October, a video of a group of men attacking, stripping, and sexually assaulting a woman went viral in Bangladesh. Incidents of rape and sexual assaults like this are a window into understanding the state of  sex-based inequality in a given society. The laws, however, must be taken into account as well, particularly if they reflect an essential male perspective and are written in gender-insensitive terms. I will explain below that in case of Bangladesh,  sex-based inequality gets revealed when an illusory  sex-equality clause of Bangladesh Constitution intersects with the country’s crippled commitment to the Women Convention, and sex-based inequality gets manifested through the retention of colonial-era substantive and procedural legal framework. Warum die “Reform” des Sexualstrafrechts keine ist

Wenn ein Unrechtszustand länger andauert, kann es geschehen, dass er als Normalität wahrgenommen wird. Dies zeigt auch der aktuelle Gesetzentwurf zur Reform des Sexualstrafrechts, welcher nicht auf fehlendes Einverständnis abstellt, sondern in einem Sondertatbestand des „sexuellen Missbrauchs“ einige Konstellationen aufzählt, in denen ein sexueller Übergriff trotz fehlendem Widerstand strafbar ist. Der Vergewaltigungsmythos des unbedingten Widerstandes wird damit als Regelfall bestätigt, und Betroffene, die sich nicht physisch wehren, werden terminologisch wie dogmatisch mit Geschäftsunfähigen gleichgestellt.
