Warum die “Reform” des Sexualstrafrechts keine ist

Wenn ein Unrechtszustand länger andauert, kann es geschehen, dass er als Normalität wahrgenommen wird. Dies zeigt auch der aktuelle Gesetzentwurf zur Reform des Sexualstrafrechts, welcher nicht auf fehlendes Einverständnis abstellt, sondern in einem Sondertatbestand des „sexuellen Missbrauchs“ einige Konstellationen aufzählt, in denen ein sexueller Übergriff trotz fehlendem Widerstand strafbar ist. Der Vergewaltigungsmythos des unbedingten Widerstandes wird damit als Regelfall bestätigt, und Betroffene, die sich nicht physisch wehren, werden terminologisch wie dogmatisch mit Geschäftsunfähigen gleichgestellt.
