Soft Law’s Increasing Clout

The non-binding nature of soft law is rather self-evident, yet, its influence is growing, as reflected in the recent Jemerak case, decided on 5 September 2024. While the judges in Luxembourg explicitly stated that the Commission’s guidance document had no effect on their interpretation of Union law whatsoever, their decision de facto indirectly reviewed that document. Soft law, hardcore?

Soft law offers the possibility of agile and flexible regulation that can adapt to dynamic digital developments. However, due to its non-binding nature, soft law is not considered to be very effective. With the Digital Services Act (DSA), however, the EU is taking an - at least from a legal dogmatic perspective - unconventional approach by combining hard and soft law in a unique way. The DSA itself is a legally binding EU regulation, but it provides for soft law instruments and even contains provisions for their legal enforcement. Although such regulatory techniques are well known in EU law, they at least call into question the public perception of the DSA as the ‘constitution of the internet’. Soft law, hardcore?

Soft Law bietet die Möglichkeit der agilen und flexiblen Regulierung, die sich gerade an die dynamische digitale Entwicklung anpassen kann. Allerdings gilt Soft Law durch seine unverbindliche Natur als wenig effektiv. Mit dem Digital Services Act (DSA) beschreitet die EU jedoch einen unkonventionellen Weg, indem sie Hard Law und Soft Law in – zumindest aus dogmatischer Perspektive – eigentümlicher Weise miteinander verbindet. Der DSA ist selbst eine rechtsverbindliche EU-Verordnung, welche jedoch Soft Law Instrumente vorsieht und sogar Vorschriften zu ihrer rechtlichen Durchsetzung enthält. Derlei Regelungstechniken sind im Unionsrecht zwar durchaus bekannt, doch stellen sie zumindest der öffentlichen Wahrnehmung des DSA als ‚Verfassung des Internets‘ in Frage. Risky Recommendations

2024 will see numerous elections, including the European Parliament Elections in June. The Digital Services Act (DSA) obliges Big Tech to assess and mitigate systemic risks for “electoral processes”. The Commission published Draft Guidelines on the mitigation of systemic risks for electoral processes and sought feedback from all relevant stakeholders. While the protection of election integrity is a laudable aim, the Guidelines as proposed would not rebuild but further erode citizen trust in the digital environment and democratic processes. The recommendations are too vague, too broad and too lenient as regards the suggested cooperation between Big Tech, civil society and public authorities. Continue reading >>

Warum Fehlinformation, Desinformation und Hassrede nicht gleich behandelt werden sollten

Der Umgang mit Fehlinformationen, Desinformationen und Hassrede im Internet ist ein hochaktuelles Thema. Eine im Juni 2023 vorgestellte Politikrichtlinie der UN zielt darauf ab, eben jene Phänomene zu bekämpfen. Es erscheint jedoch nicht sachdienlich Fehlinformationen, Desinformationen und Hassrede ähnlich bzw. gleich zu behandeln, wie es der UN Entwurf momentan vorsieht. Dieser Blogpost vertritt daher die These, dass zumindest Fehlinformationen - also unabsichtlich unrichtige Aussagen - anders behandelt werden müssen als bewusste falsche oder verletzende Äußerungen im Internet. Parallel Paths that Need to Cross?

The questions raised by the use of soft deals - and soft law more generally - in the Area of Freedom Security and Justice (‘AFSJ’) are numerous and complex. This post focusses on the justification behind the use of soft deals in the field of readmission, in order to develop two reflections: First, in a legal system founded on the rule of law, recourse to soft deals to elude constitutional constraints is questionable tout court. And secondly, if certain constitutional constraints can arguably be side-lined through the use of soft deals, in the name of flexibility and speed, others must necessarily remain operative and frame the conduct of EU institutions. In the author’s view, at least those Treaty principles that govern EU institutional action independently on the legally binding nature of its outcome remain relevant. Among these, a prominent role in framing the use of soft deals can be attributed to the principle of institutional balance, enshrined in Art. 13(2) TEU. Continue reading >>
